It is traditionally said that the first Monday in January is known as “Divorce” or “D day” by family lawyers, due to the apparent huge increase in family law enquiries on that day.  The same story is rolled out every year by the media, but is it correct?

Probably not.  It is true that new enquiries to family and divorce lawyers tend to reduce during school holidays, perhaps as couples are focusing more on their children and their forthcoming time off than on separating or starting divorce proceedings.   This usually results in an increased number of new enquiries once the schools have resumed, and couples then have the time, space and funds available to reflect and seek legal advice.  This will often mean that in September/October, after the school summer holidays end and again in January/February, once the schools return after the Christmas holidays, family lawyers tend to see an increased number of new client enquiries.

However, the “D Day” phenomenon certainly has to be taken with a pinch of salt.
